BSQ partner Roger Sahota who specialises in domestic and international criminal law addressed the first virtual meeting of the Defence Extradition Lawyers Forum last week.

Roger spoke about the case of S v. the United Kingdom, which is due to be heard before the European Court of Human Rights. Roger’s client S is said to be a leading member of a Mexican drug cartel and his extradition from the UK is sought by the United States of America.

The European Court has imposed a stay preventing S’s removal to the United States until the case is heard. If he is returned to the United States, S may receive a life sentence. The case concerns the compatibility of the arrangements for life sentence prisoners in the United States with Article 3 of the European convention of human rights which stipulates that

“no one shall be subjected to torture or to inhuman or degrading treatment or punishment.”

Full argument in the case is anticipated to take place in 2021. You can read more about our extradition solicitors and their expertise in representing individuals who are sought for extradition outside the UK here.
