Prosecuted for driving with no insurance? When keeping your licence could mean keeping your livelihood make sure you have the best possible representation both in and outside court.

If you are accused of driving without insurance then as the driver of a vehicle, you are required to prove that you have a policy of insurance that would have covered you to drive that motor vehicle at the relevant time.

There are occasions when someone may have genuinely believed that they had insurance when in fact they did not. The offence of No Insurance is what is known as a strict liability offence. In simple terms, it means that if you drive with no insurance, you are guilty of the offence.

There are many types of no insurance cases. You may be accused of driving with no insurance in the following situations -

  • Driving with insurance that they didn’t realise had expired or cancelled

  • Driving with the incorrect or insufficient insurance cover

  • Allowing or causing another person to drive their vehicle without valid insurance


Avoiding Points or a Ban - Special Reasons Argument

In situations where there appears to have been a genuine and honest mistake on the part of the driver, then it may be possible to argue Special Reasons to avoid points on your licence. If a Court accepts your Special Reasons argument, then there is a discretion not to endorse your licence with penalty points.

Penalties

You could be offered a Fixed Penalty Notice for an offence of No Insurance which comprises of a fine of £300.00 and six penalty points.

However, if a Fixed Penalty Notice is not offered then you could be required to attend at Court by way of a Summons being issued. If your case is dealt with in the Magistrates Court then you could receive 6 to 8 penalty points or even a ban as well as a fine.
