Two years after our initial instruction BSQ have successfully secured the acquittal of our professional client B on indecent images charges.

The case against T is an interesting case study in how prosecutors and police investigators often fail to properly apply the correct law relating to indecent images cases.

During that time the CPS had repeatedly failed to address our representations that the evidence against B was not sufficient to meet the Code for Crown prosecutors test for a realistic prospect of conviction. As is sadly often the case, a full review of the evidence was undertaken after the CPS decided to appoint trial counsel only a few days before B’s trial was due to start. Having reviewed our representations that the evidence did not show that our client deliberately download the illegal material found on B’s devices, the Prosecution decided to discontinue the proceedings.

B was represented throughout and in the Crown Court by BSQ partner Roger Sahota.

BSQ had earlier filed an independent expert’s report highlighting failings in the CPS forensic analysis. BSQ have noted that errors often arise in the prosecution of indecent images cases when, because of cost cutting measures, the CPS do not conduct a full forensic analysis when triaging devices seized from an Accused and instead rely on streamlined reports often produced by police officers who are not (in BSQ’s opinion) properly qualified independent digital forensic experts.
