James Skelsey successfully resisted an ASBO application being brought by a Local Authority to exclude the Respondent from the area where they had lived all their lives.
He was able to marshall the support of ex-neighbours, local councillors, MP, businessmen and other prominent members of the community amassing in the region of thirty witnesses who were able to state they did not believe that an ASBO was “necessary” in this instance.
James was therefore able to establish that the second limb of the test that needs to be applied by the Court in order to grant an order was not made out.
