Jonathan Black

Professional Experience

Having briefly practiced at the bar, Jonathan re-qualified as a solicitor with higher rights of audience to appear before the Higher Courts. Jonathan has appeared before the Court of Appeal, and also in the Queens Bench D vision of the High Court.

Jonathan has a reputation as a tenacious advocate and vast experience in dealing with a broad range of criminal matters including crimes of a serious and violent nature. He has an in-depth knowledge of Magistrates Court procedure and was a lecturer in Criminal and Civil Litigation at Kingsway College, London. He is a panel member of the Criminal Cases Review Commission. Jonathan is also a member of the London Criminal Courts Solicitors Association, Solicitors Association of Higher Courts Advocates and Liberty.

Jonathan has a special interest in representing parents who face prosecution under the Education Act for failing to secure their children’s attendance at school.

    Notable Cases Include

    B v LBI. The applicant was a parent who was unable to secure her teenage son’s attendance at school. It was submitted that the prosecution of a parent under s444 (1) of the Education Act 2004 was a breach of Article 6(2) of the European Convention on Human Rights. The court acknowledged that in many circumstances, it was inappropriate for such prosecutions to take place.

    Re MT . As Solicitor Advocate Jonathan appeared before the divisional court on behalf of a defendant who was transferred under s51 of the CPIA 1998 in custody pending the provision of a surety. As he had not been released on bail he should have been produced before the court within 7 days. The High Court Judge agreed that the detention was unlawful once 7 days had passed and ordered his immediate release. The decision led to a policy change affecting all Magistrates Court requiring them to specify a 7 day return date in such circumstances.
